GURUGRAM, Sept 15: Woman biker Shivani Chauhan, who goes by the name Sia on social media, has released another video making serious allegations against Kalyan Bainsla, the accused in the Gurugram hit-and-run case, even as police have added an attempt-to-murder charge against him.
In the video, Sia questioned why Bainsla did not stop after his car hit her motorcycle if he was genuinely distressed by the incident.
Gurugram Police have now added Section 109 of the Bharatiya Nyaya Sanhita (BNS), relating to attempt to murder, to the case. The provision carries imprisonment of up to 10 years.
Police had earlier registered a case suo motu at the Sector 56 police station. According to ACP (Headquarters) Abhilaksh Joshi, the FIR initially invoked Sections 281 (rash driving) and 125 (causing hurt) of the BNS.
Sia alleged that she was targeted because she is a woman biker and claimed there was a deliberate attempt to stop her. She said her life could have been in danger and alleged that the accused did not stop to check whether she was safe after the collision.
“I feel ashamed of such people. Women feel unsafe on the roads of Delhi and Gurugram,” she said.
She also claimed that two videos that have surfaced in connection with the incident provide evidence of what happened. According to her, the accident was captured on camera and shows the car hitting her motorcycle before the driver fled the spot.
Another video recorded by a rider travelling behind Sia has also surfaced on social media.
The footage, posted by Instagram user ‘youknowabhishek_’, purportedly shows the car driver signalling Sia to stop. When she allegedly did not stop, the car was then steered towards her sports bike and hit it from the side. The Instagram user said the incident had made him question the safety of women in Gurugram.
Sia, a Delhi resident, has completed a course in fashion designing and contested the 2022 municipal elections from Kalkaji. Her father, Roshan Chauhan, is an Aam Aadmi Party member.
“We have identified the accused, and three special teams have been formed to nab him,” Joshi said.
Sia had earlier said she was riding her Aprilia RS 457 sports bike with a group of bikers on Golf Course Road on Sunday when the incident occurred. She also alleged that the occupants of the car approached her and misbehaved with her, and claimed they appeared to be intoxicated.
Bainsla, however, admitted that the collision was his fault but denied deliberately hitting Sia. He said he lost control of his car near a U-turn.
“About 20 to 22 motorcyclists sped past me. I didn't realise a young woman was riding one of the bikes; I had simply asked her and the young man accompanying her to slow down. I did not hit them intentionally,” he said.
“She was turning without checking her mirrors; just then, near a U-turn, I lost control of the car, and the collision occurred. It was my fault; I admit it,” Bainsla added.
Bainsla, a gym owner who describes himself as an international kabaddi player, said he fled the scene because he feared that the group of bikers would attack him and his family.
He said he was travelling with his sister and two cousins at the time and denied making any gestures towards Sia. Bainsla has also deactivated his Instagram account following the controversy.
