Jammu-Kashmir: On the petition, the High Court said – it is the right of the government to decide on the permission of the Muharram procession

Jammu Aug 04 :- The Jammu and Kashmir and Ladakh High Court, while leaving it to the government to decide on the process of taking out Muharram from Guru Bazar to Dalgate in view of the situation in the Kashmir Valley, saying that due to special circumstances, the opinion of the administration, security agencies and the parties concerned would have been important. Is.

The tradition of taking out Muharram processions in the city center has been banned since 1989. The court directed that the competent authority should take a decision on this within three days.

A registered trust of the Shia community of Srinagar had filed a PIL through its secretary Agha Syed Mujtaba Abas, asking the state authorities to specifically allow the Shia community to take out a religious procession from Guru Bazar to Dalgate on August 8, 2022. Instructions were sought to be given. The trust had also sought directions to provide necessary security for the procession.

A bench of Chief Justice Pankaj Mitthal and Justice Wasim Sadiq Nargal, while hearing the petition, said that taking out religious processions, especially in Kashmir, depends on the law and order situation. The bench said that this court is unable to assess the law and order situation as well as the involvement of security of the nation in taking out such religious processions. The security agencies and other parties should take cognizance of this and form an opinion on the basis of law and order situation, religious harmony and security of the nation.

The court said that the petitioner has filed a representation in this regard to the Commissioner Secretary, Home on June 25 this year. On this, Advocate General DC Raina said that the Commissioner Secretary will consider the observations made by the court. “In view of the above facts and circumstances, we dispose of this writ petition with a direction to the Commissioner, Secretary, Home or any other competent authority to consider the above representation of the petitioner at the earliest within a period of three days,” the court said.(AGENCIES)
