Contempt petitions in J&K HC fail to move Dulloo

Jammu, May 22: Principal (then) Sunanda Raina wrote a “Reminder’’ addressed to Atal Dulloo on 28-08-2018 seeking directions with 1. Respect to regularisation of petitioners 2. With respect to release of funds for payment of pending wages to need based workers, including petitioners. She wrote in the official letter No AHJ/2018/1882-85 regarding this and it was mentioned “Subject: Judgement/Directions of Honourable High Court in the case SWP No 1170 of 2017 titled Smt Krishna & Ors versus State of J&K & Ors, SWP no 17 of 2017 titled Smt Krishna & Ors V/S State of J&K & Ors and further contempt petition 584/2017 in SWP No 17 of 2017. In the same communication, it also quoted Reference: This office letter No AHJ/2018/1222 dated 20-07-2018.
Copies of this letter were also sent to Sh H A Siddiqui, Sr AAG, Honourable High Court of J&K at Jammu; Additional Secretary (Law), HME, Civil Secretariat, Srinagar and Sr Law Officer, GMC, Jammu. What was it that Dulloo did in response to the contempt petition and earlier petitions mentioned in the communication? Well, he twiddled his thumbs, apparently, and was guided by “Chhota Dulloo’’ in this, a senior doctor working in GMC said.
Intrigued, when the doctor was asked who was he referring to as “Chhota Dulloo’’, the Consultant replied angrily: Sabko pata hai. Aapko pata nahin hai? (Everyone knows about who I am referring to. How can it be that you do not know?) He then went on to explain that a clerk named Sujeet Mattoo in Dulloo’s personal section is the most powerful person, second only to Atal Dulloo. Mattoo was earlier working in Jammu Kashmir Medical Supplies Corporation Limited (JKMSCL) and was specially brought into the personal section by Atal Dulloo. Mattoo is a guaranteed unofficial parallel channel of communication with Atal Dulloo.
The Consultant alleged that anything that reaches Dulloo via “Chhota Dulloo’’ is guaranteed to get a response from the Financial Commissioner. Other important letters and communications, including the contempt petition being faced by HME are routinely dismissed with contempt. This is why Dulloo apparently ignored the communication of OSD to Advisor (B) sent to him on March 16, 2021, and casually marked to Principal, GMC, Jammu, without even going through the contents which related to matters repeatedly brought to his notice. From time to time, by different people, all junior to him in the hierarchy. When Advisor (B), senior to him, and the authority to whom Dulloo reports marked a letter to him, he did not apply his mind to resolve issues.
“Dulloo is secure in the knowledge that he has political backing of people who matter in J&K. He also knows that Mr Rajeev Rai Bhatnagar is there but is hardly connected to masses, or taking an overtly political stance. This is the reason he (earlier) routinely ignored many of the missives from Mr Vijay Kumar also, who was looking after the department before Mr Bhatnagar,’’ another Professor of SMGS Hospital said. He also promised to give some documents where Dulloo had practically over-ruled Mr Vijay Kumar by just sitting over his communication and doing nothing. “Dulloo is philosophical like late PM PV Narasimha Rao who seemed to believe that `no decision’ was also a decision to cock a snook at Mr Kumar.’’
