Samba Admin alleged of not adhering to court ruling
Samba: The authorities in Samba area in Jammu division have sent the the judicial ruling and norms for a toss as they demolished a structure a case of which is sub-judice before a court in same distirct of which those at the helm of affairs are respomdents.
The complaintant alleged the district administration and police of defying the nroms set by judiciary to which even the Prime minister of County is subordinate and has to follow the orders cum ruling with litter and spirit.
The aggrieved owner of the structure said that contempt notice was issued against Rohit Khajuria Deputy Commissioner Samba, Kesar Malik Tehsildar Bari Brahmana, Surinder Kumar Naib Tehsildar Bari Brahmana,Sunil Kesar SDPO, Bari Brahmana & Arjun Singh Chib SHO Bari Brahmana for disobeying the court order dated 18-08-2017 & demolished the structure of owner Chain Singh S/o Raval Singh R/o Birpur at Birpur on 11- 07-2020.
He said a case titled Chain singh V/S State through Commissioner Secretary Revenue J&K Government Jammu is pending at a court here before Sub Judge, Samba to which Tehsildar Bari Brahmana & Naib Tehsildar Bari Brahmana are also respondents.
Chain Singh said that he filed the civil case one title Chain Singh V/s Commissioner Secy. & Others land measuring 15 K-18 M under Khasra No. 826 , land measuring 4 kanal under khasra No. 826 min land measuring 12 kanal under khasra No. 836 in where next date is 18-07-2020 situated at Birpur and another case of the same land titled Chain Singh V/S Vice Chairman JDA & other in which next date is 11-08-2020.
He said In both the cases Hon’ble Court direct the respondent Deputy Commissioner, Samba & others & respondent Vice Chairman JDA & Others maintain status quo vide its order 18-08-2017 and 17-02-2020 which is still in operate.
Hon’ble Court vide its order dated 18-07-2020 in both the cases direct SHO P/S Bari Brahmana to implement court order dated 18-08-2017 & 17-02-2020 against the respondents in letter and spirit, but Deputy Commissioner, Samba showed high-handedness and did not bother about the court ruling there by ordered the demolisin of the structure, he said.
He comlianed that this is Mockery of judicial system because despite orders of civil court & that of Financial Commission. Where state land converted in ownership land vide order dated 10-03-1995 & Financial Commissioner recommend case to addational Deputy Commissioner, Samba for entry in revenue record.
Moreover, Divisional Commissioner Jammu also directed Deputy Commissioner Samba. & other lower Revenue staff of District Samba to maintain status Quo but Deputy Commissioner, Samba in the utter violation of civil court order & Revenue Court order demolished the structure of Chain Singh and didn’t withstand the judiciary ruling.
