Jammu, Nov 20, TEN Network | Prof. Bhim Singh, Chief Patron of NPP, former Legislator for 15 years in J&K, Sr. Executive Member of Supreme Court Bar Association & Executive Chairman of State Legal Aid Committee, J&K today expressed shock on the statement of Union Home Minister that situation is returning back to normalcy in Kashmir saying that the Central leaders have tried to mislead the Parliament on the situation that has been sweeping the Valley of Kashmir for than three months. He disagreed with the statement made by the Union Home Minister that situation in Kashmir Valley is returning to normalcy.

He said if it is so, shall the government of India tell the Parliament of India what was the necessity of bringing policemen from the neighbouring states to Jammu and Kashmir and why the educational institutions in Jammu and Kashmir and particularly in the Valley have remained shut for more than three months?

He also asked the Govt.of India and particularly the Home Minister of India to justify detentions and arrests of thousands of Indian citizens in Kashmir following imposition of President’s Rule in the Valley under the so-called Public Safety Act which does not exist any longer after the withdrawal of Article 35-A from Chapter-III of the Constitution of India by August 5, 2019.

The NPP Supremo conveyed the message to the Members of Parliament affiliated to different political parties to kindly ask the government how a sitting Member of Parliament, Dr. Farooq Abdullah, and other activists/leaders of opposition parties in J&K could be detained under Public Safety Act which has ceased to operate after the imposition of President’s Rule in J&K and removal of Article 35-A.

It was Article 35-A which had extended jurisdiction/power to J&K government to bar any of the fundamental rights in J&K. There is no 35-A in the chapter of Indian Constitution and therefore no fundamental rights of the citizens of India in J&K shall be barred by the State government.

Prof.Bhim Singh has demanded an apology for detaining the former leaders/political activists including the former Chief Ministers and sitting Member of Parliament, Dr. Farooq Abdullah under PSA in detention.  He said that Panthers Party shall move the Supreme Court against the illegal, improper and unconstitutional detention of citizens of India in J&K.
